PERITO DA ACADEMIA BRASILEIRA DE CIÊNCIAS CRIMINAIS – ABCCRIM CONSTATA MANIPULAÇÃO EM VÍDEOS E DECISÃO JUDICIAL DETERMINA A EXCLUSÃO DO CONTEÚDO NA INTERNET
Uma perícia conduzida pelo perito Ricardo Caires, Presidente da Comissão Nacional de Perícia Audiovisual da ABCCRIM, concluiu que vídeos publicados em dezembro de 2021 pelos advogados Paulo Farias e Diego Mesquita em blogs e redes sociais, nos quais o prefeito do município do Cabo de Santo Agostinho supostamente teria participado de esquema de corrupção, foram manipulados. Caires afirmou que há trechos em que o áudio utilizado não pertence ao vídeo. Segundo ele, em um trecho específico do áudio a pessoa que aparece no vídeo sequer abre a boca, indicando que o conteúdo original do vídeo foi totalmente editado.
Em função da conclusão pericial, no último dia 04 de janeiro a 1ª Vara Cível da Comarca do Cabo de Santo Agostinho determinou que Paulo Farias e Diego Mesquita retirem de suas redes sociais e blog os vídeos supostamente manipulados em até 72h, sob pena de multa diária de R$ 500,00.
Por se tratar de uma decisão provisória em face de uma tutela de urgência, na qual os réus ainda não foram ouvidos, o juiz reconheceu a liberdade de expressão de Paulo Farias e Diego Mesquita e os intimou para que lhes seja assegurado o direito à ampla defesa e ao contraditório.
A defesa do Prefeito está sendo instruída por Thiago Santos, advogado associado da ABCCRIM, com base no parecer do perito Ricardo Caires dos Santos.
