Suspensa demolição de galpões no Cais José Estelita
A justiça, através do juiz Augusto Napoleão Sampaio Angelim, da 5ª Vara da Fazenda Pública da Capital, determinou por meio de liminar, no início da tarde desta terça-feira (26), a suspensão da demolição de galpões na área do Cais José Estelita. Visando ao empreendimento imobiliário Consórcio Novo Recife, a demolição havia começado nessa segunda (25) após autorização da Prefeitura do Recife. Em caso de descumprimento da liminar, os responsáveis pela derrubada serão multados em R$ 5 mil por dia.
A decisão atende a uma Ação Civil Pública do Ministério Público de Pernambuco (MPPE). Representantes do órgão retiraram a placa que dava o alvará para a realização das obras e colocaram outra no lugar, avisando sobre a suspensão imediata da demolição.
“Diante do exposto, com fundamento no art.300, do Código de Processo Civil, defiro a tutela provisória de urgência com a finalidade de determinar ao município do Recife que suspenda, imediatamente, a licença deferida para a execução das obras do Cais José Estelita… Em caso de descumprimento da presente liminar, arbitro multa diário de R$ 5.000,00 (cinco mil reais)”, diz o juiz Augusto Napoleão Sampaio Angelim na liminar.
Segundo o representante do Consórcio Novo Recife, Eduardo Moura, a demolição ficará parada até segunda ordem. “Em todos os processos anteriores, obtivemos êxitos. Junto com o nosso setor jurídico, já estamos vendo o que pode ser feito para que as obras possam voltar a ser retomadas”, disse.
