Projeto de Lei proíbe multa por perda de ticket de estacionamento
Os vereadores do Recife aprovaram por unanimidade ontem um projeto de lei, o de número 320/2017, que proíbe a cobrança de taxas por perda dos tickets de estacionamento. De autoria do vereador Chico Kiko, o projeto deve ser encaminhado para sanção ou não do prefeito Geraldo Julio.
O texto aprovado pelo plenário da Câmara Municipal afirma que os fornecedores de serviços e os estabelecimentos comerciais e de entretenimento são obrigados a manter registros de entrada e saída de veículos. A regra vale tanto para os casos dos locais disporem de estacionamento próprio ou estacionamentos de terceiros.
No caso de ocorrer a perda ou extravio do cartão ou ticket de estacionamento, acrescenta o projeto de lei aprovado pelos vereadores do Recife, o registro será consultado para que seja cobrado do consumidor apenas o tempo de utilização do serviço.
“É direito de todos pagar apenas pelo que consumiu. Cobrança de multa por perda ou extravio se caracteriza como prática abusiva, conforme o Código de Defesa do Consumidor, possibilitando ao usuário lesado a reparação de eventuais danos e transtornos”, disse o autor do projeto.
O projeto de lei proíbe também a cobrança de qualquer tipo de multa ou a aplicação de penalidades motivadas pela perda ou extravio do cartão de ticket de estacionamento, desde que o proprietário do veículo automotor apresente a Carteira Nacional de Habilitação (CNH) e a documentação do veículo.
A aprovação ocorreu após o projeto de lei obter pareceres favoráveis das comissões de Legislação e Justiça e de Acessibilidade e Mobilidade Urbana da Câmara Municipal do Recife.
