Lista de cabimento de agravo de instrumento deve ser ampliada, diz Nancy
A Corte Especial do Superior Tribunal de Justiça começou a julgar nesta quarta-feira (1º/8) os recursos repetitivos que discutem se a lista de possibilidades de interposição de agravo de instrumento é exaustiva ou exemplificativa. O rol está no artigo 1.015 do Código de Processo Civil e o tribunal discute se o dispositivo permite o cabimento de agravo contra possibilidades não expressamente previstas.
Decisões interlocutórias precisam de forma mais célere de análise, afirma ministra Nancy Andrighi, em voto na Corte Especial.

O julgamento começou nesta quarta-feira (1º/8) com voto da relatora, ministra Nancy Andrighi, que defendeu dar maior abrangência ao dispositivo do CPC. Mas a discussão foi suspensa por pedido de vista da ministra Maria Thereza de Assis Moura.
De acordo com o artigo 1.015 do CPC, o agravo de instrumento cabe contra decisões interlocutórias que tratem de 12 situações específicas. Processualistas criticam a restrição, já que o CPC anterior, de 1973, dizia genericamente que o agravo de instrumento era cabível contra decisões interlocutórias anteriores à sentença final.
Em novembro de 2017, a 4ª Turma do STJ decidiu que a lista do dispositivo deve ser ampliada em algumas situações. Naquele caso concreto, a decisão foi de autorizar o agravo de instrumento contra alegações de incompetência, o que não está previsto no artigo 1.015.
Nesta quarta, a ministra Nancy votou em sentido semelhante. Para ela, o dispositivo do CPC deve ter a “taxatividade mitigada”. Ou seja, o agravo de instrumento deve ser admitido quando for apresentado para discutir questões urgentes e de difícil reparação, caso não sejam apreciadas no momento em que questionadas.
No caso da decisão da 4ª Turma, venceu a tese do ministro Luis Felipe Salomão. Segundo ele, a lista do artigo 1.015 deve ser ampliada para casos em que a jurisprudência ou a própria lei exijam análise imediata do Judiciário. Naquela ocasião, a turma discutiu uma alegação de incompetência, que o parágrafo 3º do artigo 64 do próprio CPC manda serem analisadas com “imediatamente”.
De acordo com o voto da ministra Nancy desta quarta, o Judiciário precisa definir alguma forma de análise mais célere de decisões interlocutórias, mesmo que elas não estejam descritas no artigo 1.015. Por isso a “taxatividade mitigada”.
A ministra Maria Thereza pediu vista para estudar o assunto com mais profundidade, diante da abrangência e importância do caso e já que a discussão ainda é recente — o CPC foi aprovado em março de 2015 e entrou em vigor um ano depois, tendo o debate sobre o cabimento de agravo de instrumento como um dos principais.
