Lei Geral de Proteção de Dados (LGPD) pode punir empresas e órgãos públicos a partir de agosto
A Lei Geral de Proteção de Dados pessoais (Lei n. 13.709, de 14 de agosto de 2018) foi aprovada em 2018 e entrou em vigor 2020, porém, sem penalizações. Depois de ser adiada três vezes, a expectativa agora é que elas aconteçam em agosto deste ano. Entre as punições previstas, a que mais preocupa empresas é a aplicação de multas, que podem chegar a R$ 50 milhões.
A Lei, que representa uma inovação na área de tratamento de dados, funciona como um seguro, já que protegem a maneira como instituições coletam, armazenam e disponibilizam as informações de usuários. Sua importância é clara para a integridade e segurança dos conteúdos.
“As punições podem ser de diversas formas, como simples advertência, multas diárias ou multas sobre o faturamento, com o valor máximo de 50 milhões de reais. Além disso a empresa pode ser suspensa de utilizar dados pessoais, que pode gerar até a pausa de funcionamento. A Agência Nacional de Dados pode tornar público esse descumprimento, que pode gerar um grande dano para o estabelecimento”, explicou a advogada especialista em LGPD Daniela Vasconcelos.
A Autoridade Nacional de Proteção de Dados (ANPD), que será responsável pela fiscalização e aplicação de sanções, tem como alvos principais os bancos, e-commerces e empresas de telefonia, já que eles têm os maiores bancos de dados e precisam da segurança adequada. Empresas menores, porém, devem ficar atentas, seguindo o processo à risca. Com o mundo em constante tecnologia e a ameaça de exposição frequente, o ideal é que a lei seja cumprida devidamente.
“A LGPD não é exclusiva para empresas. Todo profissional que exerça atividade com intuito de aferir vantagem financeira, ou seja, atividade comercial, deve se enquadrar à LGPD”, acrescentou o advogado especialista em LGPD Gabriel Vasconcelos.
O cidadão que se sentir lesionado, porém, poderá entrar na justiça com ações, levando à formalização de possíveis processos. Essas instituições públicas também têm grandes riscos em relação ao vazamento de dados.
“O princípio básico da LGPD é a transparência, as empresas precisam mostrar o que fazem com os dados dos clientes. Não se trata apenas de dados de internet, mas os dados colhidos presencialmente, tudo isso é protegido pela lei. Exemplo: quando vamos a uma farmácia, sempre solicitam um cadastro, com várias informações pessoais. Se a empresa não demonstrar ao cliente o que fará com esses dados, ela estará descumprindo a Lei. Se a empresa utilizar o dado sem autorização do cliente, ela pode ser penalizada”, acrescentou Gabriel.
Com a maior proteção e segurança em compras online, contas em bancos, redes sociais e inscrições, a LGPD ajuda diferentes setores e serviços, e a esperança é de que as falhas de sistemas sejam corrigidos, além das aplicações de multas e o benefício do cidadão.
