15 anos do Simples Nacional
A Lei que criou o Simples Nacional está completando 15 anos. Antes desse marco, não havia no País uma legislação empresarial em seus diversos aspectos (tributário, previdenciário, trabalhista e comercial) que garantisse em termos nacionais o tratamento diferenciado para micro e pequenas empresas, apesar das disposições constitucionais.
Nesse sentido, gostaria de lembrar a memorável luta, que reuniu à época todo os segmentos empresariais do País, e que resultou em abril de 2005, na criação da Frente Empresarial pela Lei Geral, que tive a honra de coordenar como Presidente da Confederação Nacional da Indústria (CNI).
Essa mobilização resultou na histórica “Marcha para Brasília” que congregou em torno do mesmo objetivo mais de 4 mil pessoas e que culminou com a entrega de um Projeto de Lei aos Presidentes da República, do Senado e da Câmara dos Deputados, que viria a se tornar a futura Lei do Simples Nacional.
Devemos valorizar os benefícios proporcionados por esse regime tributário simplificado, desde então, para cerca de 18 milhões de micro e pequenas empresas e empreendedores individuais, que representam 99% do tecido empresarial, geram 55% do emprego formal, participam com 44% da massa salarial e são responsáveis por cerca de 30% do PIB nacional.
Ao longo desse período, como parlamentar acompanhei e pude contribuir com inúmeros aperfeiçoamentos do Simples Nacional, os quais destaco: a) o pagamento em uma guia única de oito tributos, sendo seis federais, um estadual e um municipal; b) a garantia de uma carga tributária menor em relação aos demais regimes tributários e c) a instituição da figura do Microempreendedor Individual (MEI), o que fomenta a formalização e assegura direitos previdenciários com uma alíquota de contribuição menor.
Apesar dos avanços do Simples, as micro e pequenas ainda são penalizadas pelos estados com o alargamento e uso indiscriminado da substituição tributária no ICMS, mesmo com as tentativas do Congresso Nacional em conter essa política tributária, que anula os benefícios da Lei Geral. Tenho a convicção de que a exitosa experiência do Simples Nacional nesses 15 anos irá nos inspirar para a construção de um sistema tributário mais funcional e justo, não somente para as micro e pequenas empresas, mas para toda a sociedade brasileira.
