BR-476: Suspenso leilão que pode afetar 600 famílias quilombolas no PR
Liminar veio depois de atuação da DPU em favor das comunidades quilombolas que vivem às margens rodovia
A Defensoria Pública da União (DPU) entrou com pedido liminar para suspender o leilão do lote 1 da Rodovia BR-476, no Paraná, por entender que as comunidades quilombolas que vivem às margens dessa estrada não foram ouvidas antes do início do processo licitatório. A liminar foi concedida nessa terça-feira (5) pela 11ª Vara Federal de Curitiba. O leilão, realizado no dia 25 de agosto, estava em fase de recursos, com previsão de homologação do resultado pela Agência Nacional de Transporte Terrestres (ANTT) no dia 27 de outubro. A expectativa de investimentos chega à casa dos R$ 13,1 bilhões, em 30 anos de concessão, com a expansão e a melhoria das rodovias, além de custos operacionais como serviço médico, mecânico e pontos de descanso para os caminhoneiros.
A DPU alega que as comunidades quilombolas Feixo, Restinga e Vila Esperança de Mariental, localizadas dentro dos limites do município da Lapa (PR) e que reúnem cerca de 600 famílias, seriam prejudicadas com o pagamento do pedágio instalado no km 191 da BR-476, entre as comunidades e a cidade. Essas comunidades são certificadas pela Fundação Cultural Palmares, desde 2006, como sendo tradicionais.
A juíza federal Sílvia Regina Salau Brollo acolheu o argumento da DPU de que os integrantes dessas comunidades, para terem acesso aos serviços públicos básicos prestados pelo município, como saúde, educação e acesso à Justiça, vão ter de passar necessariamente pela praça de pedágio.
”Esse é um caso emblemático porque promove o resgate do direito à consulta livre, prévia e informada das comunidades tradicionais, ressaltando que ela não se confunde com as audiências públicas realizadas. Com a liminar concedida, fica suspenso o leilão e será possível se buscar a participação efetiva no processo de concessão das comunidades quilombolas afetadas”, analisa o defensor regional de Direitos Humanos, Rodrigo Zanetti. O defensor informou que o caso chegou a DPU pelas próprias lideranças das comunidades quilombolas afetadas.
A decisão de suspender o leilão levou em conta também o dispositivo da Convenção 169 da Organização Internacional do Trabalho (OIT), que determina “a consulta aos povos interessados, mediante procedimentos apropriados e, particularmente, através de suas instituições representativas, cada vez que sejam previstas medidas legislativas ou administrativas suscetíveis de afetá-los diretamente”. Assim, os efeitos do leilão do lote 1 ficam suspensos enquanto a ação principal não for apreciada pelo Poder Judiciário.
Leilão – O primeiro lote abrange uma extensão total de 473 km, compreendendo as rodovias federais e estaduais: as BR-277/373/376/476 e as PR-418/423/427. Segundo a Agência Nacional de Transportes Terrestres (ANTT), os principais benefícios que deverão ser feitos pela vencedora do leilão incluem 344 km de obras de duplicação, 81 km de faixas adicionais, 38 km de terceira faixa e 41 km em vias marginais.
