APOSENTADORIA SACADA APÓS A MORTE DO APOSENTADO E O CRIME DE ESTELIONATO
APOSENTADORIA NÃO RECEBIDA EM VIDA
Frequentemente, os advogados previdenciaristas ouvem o seguinte questionamento: posso sacar o valor da aposentadoria não recebida em vida pelo falecido?
As pessoas de posse do cartão e da senha da conta daquele que foi a óbito ou sendo procuradoras ou ainda curadoras, argumentam para justificar o saque a necessidade de pagar dívidas com relação ao funeral e ao tratamento do de cujus ou que era o único rendimento para sustento da família.
CRIME DE ESTELIONATO
No entanto, o que deve ser entendido é que com o falecimento do aposentado cessa não só a aposentadoria, mas qualquer outro benefício previdenciário ou assistencial que por acaso o finado percebia e que a procuração ou a curatela que porventura autorizavam o saque do benefício por terceiro, o mesmo ocorrendo com o cartão e a senha da conta bancária, perdem sua validade. A família e os cartórios civis, estes emitentes da certidão de óbito, têm o dever de comunicar a morte ao INSS para que haja a suspensão do pagamento do benefício.
Quem efetua o saque indevido, sendo notificado e se negar a ressarcir à Previdência Social, o processo é encaminhado ao Departamento da Polícia Federal e passa a ser tratado como crime de estelionato.
PENSÃO POR MORTE
Para recebimento da pensão por morte e de valores de benefícios não sacados daquele que era segurado da Previdência Social, mesmo sem se encontrar aposentado ou em gozo de outro benefício, as medidas a serem tomadas são:
Primeiro, comunicar ao INSS o óbito e havendo dependente requerer a pensão por morte. São considerados dependentes para a concessão da pensão por morte:
I – o cônjuge, a companheira (o) e o filho não emancipado, de qualquer condição, menor de 21 anos ou inválido ou que tenha deficiência intelectual ou mental ou deficiência grave;
II – os pais;
III – o irmão não emancipado, de qualquer condição, menor de 21 anos ou inválido ou que tenha deficiência intelectual ou mental ou deficiência grave.
A existência de dependente do item l exclui do direito à pensão por morte os dos itens ll e lll. Inexistindo dependente do item l, os dependentes do item ll excluirão os dependentes do item lll.
A pensão por morte será devida a contar da data do óbito quando requerida em até 180 dias para os filhos menores de 16 anos ou em até 90 dias para os demais dependentes.
Segundo, não havendo dependentes à pensão por morte os herdeiros devem requerer por meio de alvará judicial o levantamento do valor residual não recebido em vida.
