STF cassa decisão que censurou de publicação de reportagens em blog
O ministro do Supremo Tribunal Federal (STF), Luiz Fux, confirmou liminar suspendendo decisão que obrigava o Google a retirar publicações feitas em um blog de notícias no Pará.
A Ampep entrou com ação e a 2ª Vara do Juizado Especial Cível de Belém determinou que o Google, proprietário da plataforma na qual o blog está hospedado, retirasse seis matérias do ar. A Turma Recursal manteve a determinação depois de o Google entrar com recurso, mas a plataforma levou o caso ao Supremo que julgou o mérito da ação e cassou a decisão que havia determinado a retirada das reportagens.
Em sua argumentação, Fux lembrou que “é por intermédio do acesso a um livre mercado de ideias que se potencializa não apenas o desenvolvimento da dignidade e da autonomia individuais, mas também a tomada de decisões políticas em um ambiente democrático”.
Ressaltou o magistrado que a Justiça local havia restringido indevidamente a liberdade de expressão, violando o entendimento firmado pelo STF na Arguição de Descumprimento de Preceito Fundamental 130. “Impede, pois, uma maior tolerância quanto a matérias de cunho potencialmente lesivo à honra dos agentes públicos, especialmente quando existente – como é o caso – interesse público no conteúdo das reportagens e peças jornalísticas excluídas do blog por determinação judicial”, escreveu.
