POLÍCIA FEDERAL EM PERNAMBUCO DEFLAGRA OPERAÇÃO QUINTA PARCELA DE COMBATE AO ESTELIONATO, ASSOCIAÇÃO CRIMINOSA, LAVAGEM DE DINHEIRO E CONSTITUIÇÃO DE ORGANIZAÇÃO CRIMINOSA.
A Polícia Federal deflagrou, na data de hoje (29/04/2021), a Operação Quinta Parcela, em continuidade ao combate às fraudes ao Benefícios Emergenciais, os quais beneficiam parte da população com dificuldades financeiras em razão da pandemia. Os trabalhos realizados são resultantes de uma união de esforços denominada Estratégia Integrada de Atuação contra as Fraudes ao Auxílio Emergencial (EIAFAE), da qual participam a Polícia Federal, Ministério Público Federal, Ministério da Cidadania, CAIXA, Receita Federal, Controladoria-Geral da União e Tribunal de Contas da União. Os escopos da atuação conjunta são a identificação de fraudes massivas e a desarticulação de organizações criminosas, com a identificação de seus integrantes e recuperar os valores para o erário.
Somadas as ações de hoje, já se somam 60 Operações Policiais visando o combate às fraudes, com a realização de mais de duas centenas de Mandados de Busca e mais de 30 indivíduos presos. Em todo o País estão sendo cumpridos 37 (trinta e sete) Mandados de Busca e Apreensão, 05 (cinco) Mandados de Prisão Temporária e 03 Mandados de Sequestro de Bens, perfazendo um total de aproximadamente de R$ 140 mil bloqueados por determinação judicial. As ações estão sendo efetivadas nos Estados do Pará, Tocantins, Goiás, Rondônia, Mato Grosso do Sul, Pernambuco e São Paulo, com a participação de aproximadamente 140 Policiais Federais.
PERNAMBUCO:
Em Pernambuco a Polícia Federal está dando cumprimento a 05 (cinco) mandados de prisão temporária, 10 (cinco) mandados de busca e apreensão, além do sequestro e bloqueio de bens e valores mantidos em contas bancárias de 08 (oito) pessoas físicas. Todas as medidas cautelares foram expedidas pelas 24ª e 13ª Varas da Justiça Federal de Pernambuco. Os mandados foram cumpridos simultaneamente nos municípios de Caruaru/PE (05), Palmares/PE (03), Lagoa do Carro/PE (01) e Paudalho/PE(01), e foram empregados aproximadamente 60 policiais federais.
As investigações foram levadas a efeito por meio das Delegacias de Polícia Federal em Caruaru e de Repressão a Crimes Fazendários – DELEFAZ da Superintendência da Polícia Federal em Pernambuco, e se iniciaram em dezembro, após análise das notícias de fraudes aos auxílios emergenciais da Lei 13.982/2020, constantes da Base Nacional de Fraudes ao Auxílio Emergencial – BNFAE, a qual congrega as contestações de beneficiários à Caixa Econômica Federal e é fruto da Estratégia Integrada contra as Fraudes ao Auxílio Emergencial, definida pela Polícia Federal, Ministério Público Federal, Ministério da Cidadania, Caixa Econômica Federal, Controladoria-Geral da União e Tribunal de Contas da União, cujo foco é a apuração do envolvimento de associação, grupo ou organização criminosa.
Da referida análise, foram estabelecidas correlações entre os registros constantes da BNFAE, sendo possível detectar que pelo menos oito suspeitos, com endereços nos municípios supracitados, seriam os beneficiários de, ao menos, 96 (noventa e seis) contas do auxílio emergencial fraudadas, a partir das quais os envolvidos efetuaram pagamentos de 74 (setenta e quatro) boletos bancários, utilizaram-se de maquinetas de cartão de crédito e também realizaram transações por e-commerce, tudo no período compreendido entre 05/05/2020 a 03/06/2020.
A soma do montante fraudado inicialmente estimada supera R$ 60.000,00 (sessenta mil reais), valores relativos somente ao período investigado, podendo ser ainda maior. A investigação busca identificar os demais membros desta ORCRIM, outros benefícios porventura cadastrados e sacados/movimentados de forma fraudulenta, bem como o destino dos valores desviados e sua recuperação.
Os integrantes da ORCRIM são investigados pela prática dos crimes de Estelionato qualificado, associação criminosa, lavagem de dinheiro e constituir/integrar Organização Criminosa, tipificados nos artigos 171, º3º e 288 do CPB, artigo 1º da Lei 9.613/98 e art. 2º da lei 12.850/2013. Penas que se somadas, em caso de condenação, podem chegar a 30 anos de reclusão. O nome da operação faz referência à quinta fase da Operação coordenada nacionalmente pela Coordenação Geral de Polícia Fazendária-CGPFAZ, que visa combater as fraudes perpetradas contra o Auxílio Emergencial.
