PF APURA SUPERFATURAMENTO EM OBRAS CONTRATADAS PELO DNIT/AP
Macapá/AP – A Polícia Federal, Ministério Público Federal e Controladoria Geral da União – CGU, no Amapá, deflagraram nesta quinta-feira (1) a Operação Candidus II, que apura indícios da existência de organização criminosa destinada a fraudar contratos de manutenção rodoviária da BR-156, considerada a obra federal mais antiga em andamento no Brasil.
As investigações feitas a partir da análise dos contratos, verificou a ocorrência de superfaturamento nas obras no valor de R$ 6.179.116,97 (seis milhões, cento e setenta e nove mil, cento e dezesseis reais e noventa e sete centavos), em prejuízo ao erário. A apuração indica, ainda, um sofisticado esquema de esquentamento de madeiras extraídas ilegalmente de áreas preservadas e destinadas a obras contratadas pelo Departamento Nacional de Infraestrutura e Transportes – DNIT no Amapá, com o possível pagamento de vantagens indevidas a servidores públicos que integravam o esquema fraudulento das obras, que chegavam a declarar insumos em valores até 15x maiores que os praticados no mercado.
Mais de 90 policiais federais cumpriram 22 mandados de busca e apreensão nos Estados do Amapá (Macapá, Santana e Pedra Branca do Amapari), Pará (Goianésia do Pará, Santarém), Distrito Federal (Brasília), Rio de Janeiro (Macuco), Sergipe (Aracaju), Pernambuco (Recife e São Lourenço da Mata) e Paraíba (Cabedelo). Os alvos investigados objeto das medidas são empresários e servidores públicos do DNIT/AP.
A Operação de hoje é um desdobramento da Candidus I, deflagrada em 10 de novembro de 2021, quando a PF cumpriu mandado de busca e apreensão no DNIT/AP. Aquela fase foi motivada por diversas irregularidades na emissão de guias florestais no SINAFLOR/DOF, onde empresas movimentavam apenas créditos florestais, sem a respectiva madeira chegar aos pátios, indicando a utilização de madeira de origem ilegal.
Da análise do material apreendido, verificou-se, além do superfaturamento, fortes indícios que o DNIT/AP utilizou uma falsa justificativa, para realizar um aditivo contratual com a empresa favorecida pela dispensa de licitação, valendo-se do fato de as precipitações pluviométricas na data da realização do processo terem sido consideradas acima da média. No entanto, constatou-se, por meio da análise da série histórica, que reúne dados de 40 anos (1976 a 2015) de pluviometria da região, que os níveis de 2021 estavam dentro dos parâmetros considerados normais.
As investigações indicam o cometimento dos crimes de organização criminosa, peculato, corrupção ativa e passiva, fraude à licitação, falsidade ideológica e lavagem de dinheiro. Se condenados, os investigados poderão cumprir pena de até 51 anos de reclusão.
Em Pernambuco dentro da Operação Cândidus II foi dado cumprimento a 02 mandados de busca e apreensão sendo 01 (um) no endereço residencial de um engenheiro de 40 anos, natural e residente em São Lourenço da Mata/PE e 01 (um) no endereço comercial de uma engenharia que fica situada no Bairro da Ilha do Leite-Recife/PE. As buscas visam apreender Tablets, computadores, notebooks, pendrives, aparelhos celulares, dinheiro e documentos relacionados com as obras de asfaltamento da BR 156 que liga Macapá/AP ao município de Oiapoque/AP. Todo material arrecadado será enviado para a Coordenação da Operação da Polícia Federal no Amapá, a fim de subsidiar as investigações que estão em andamento.
