A ação pede a suspensão imediata do crédito tributário, devendo o IPVA ser atualizado.
Foi com espanto e repulsa que o movimento não vou pagar recebeu a notícia do reajuste abusivo do IPVA por parte do Governo Paulo Câmara no último dia útil do ano de 2021, conforme noticiado pelo professor tributarista Allan Maux.
Não bastasse o recrudescimento da economia, o desemprego recorde em Pernambuco e a pandemia que se alastra por mais de dois anos, os pernambucanos precisaram enfrentar mais um desafio, manter seus veículos legalizados.
De forma contrária a constituição, o Governo do Estado reajustou o IPVA em 33% na média, com alguns veículos superando os 170% de reajuste. Súmula do STJ já é utilizada para reajuste do IPTU, obrigando o Estado a não exceder as taxas oficiais de correção, como o IPCA, que terminou o ano de 2021 em pouco mais de 10%.
Mediante os fatos, o Movimento Não Vou Pagar teve o apoio do PTB-PE através do Presidente do partido Coronel Meira, para impetrar um mandado de segurança que suspendesse a cobrança abusiva do imposto.
Há de se ressaltar que a informalidade em Pernambuco supera os 50% e grande parte dos trabalhadores encontram seus sustentos trabalhando como entregadores e motoristas de aplicativo, e consequentemente dependem dos mesmos para sobreviver, não sendo razoável tamanha extorsão por parte do Estado.
O professor Allan Maux, primeiro a noticiar o aumento abusivo do IPVA, relembrou que vivemos em um estado democrático de direito, e que reajustes não podem ser realizados rasgando as leis vigentes.

Vivemos em um Estado Democrático de Direito que, em hipótese alguma, pode estar às margens da legalidade e moralidade, princípios constitucionais norteadores para uma boa convivência entre o Estado e a sociedade.
Diante disso, acreditando na justiça do nosso Estado, que possui o poder de manter o Executivo estadual dentro da legalidade, mínimos o movimento Não Vou Pagar de ferramentas necessárias e suficientes para que essa ação seja vitoriosa para todo cidadão pernambucano que já se encontra esmagado com um grande arrocho tributário.
O advogado Otávio Lemos, um dos fundadores do Movimento Não Vou Pagar destacou que o instrumento do Mandado de segurança tem maior celeridade que qualquer outro, e dada a gravidade dos fatos, o juiz deve decidir já nas próximas 72 horas.

“Não tenho dúvidas da ilegalidade desse reajuste, e não tenho dúvidas que se levado em consideração a letra da lei, esse reajuste será suspenso”, disse Otávio.
Para Artur Nascimento, co-fundador do Movimento Não Vou Pagar, é inaceitável a transformação do Estado em uma máquina de extorsão.
“Trata-se de confisco, um reajuste dessa natureza não é nada menos que confisco de bens”, completou.
O Movimento ainda promove no próximo dia 20 de Janeiro, uma manifestação na frente do Palácio Das Princesas, sede do Governo Estadual.
